Oh, I never really thought about it, but Instas will presume that those who've lost their votes haven't lost their votes (mostly because there would be like an Insta every Phase if it were otherwise, hahaha).  So if there are 7 Players, with 1 being charismatic and 2 having lost their votes, the max number of votes would still be considered as 8 and not 6; so an Insta would require 5 votes.
