Because it's clearly designed for children. It's more sturdy, and there's no 3D that can hurt kids' eyes. So it makes sense that they do this actually. Also in their ads little kids were using it so... yeah. Why does it even bother you.

There is a possibility in the Parent Controls thing to switch off the 3D, so this seems unnecessary.

It's sturdier without the hinges(I broke my DS lite hinges and I wasn't even that rough with it) and it's considerably smaller. So it's not just a 3DS without 3D, it does have some significant changes.

More accurately, the "screens" are just one big screen, separated by plastic. The top one just has extra protection over it.
